Data use agreement

Australia's Virtual Herbarium (AVH) data is made publically available on the understanding that its use will be consistent with efforts to preserve biological diversity. The participating herbaria are committed to improving the quality of their specimen data, and expect users to report any errors or discrepancies detected during its use. The user is licensed to use AVH data for scholarly or educational, non-commercial research purposes, subject to the following terms and conditions:

  1. The user must not represent the data as their own.
  2. No proprietary rights over the data are conferred upon the user by this licence. All intellectual property rights, including copyright in the data, are retained by the Council of Heads of Australasian Herbaria Inc. (CHAH), on behalf of the contributing herbaria.
  3. The user must ensure that CHAH is acknowledged in any use of AVH data by the words: 'Specimen data reproduced from Australia's Virtual Herbarium with permission of the Council of Heads of Australasian Herbaria Inc.'.
  4. AVH data is supplied as is. CHAH provides no warranty, express or implied, concerning the accuracy or fitness for a particular purpose of the data.
  5. The user shall use AVH data at their own risk and agrees that CHAH will not be liable for any loss or damage arising from the use of or reliance upon the data, or reliance on its availability at any time.
  6. The user warrants that the terms and conditions of this agreement are not inconsistent with any other contractual obligations they may hold.
  7. CHAH retains the right to withhold or generalise any collecting information deemed sensitive.
  8. This agreement shall be governed and construed in accordance with the laws of the Australian Capital Territory.
